PenPoint Privacy Policy

PEN-LINK, LTD. (“Pen-Link” or “we” or “us” or “our”) respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect, use, store, and safeguard your information when you use our PenPoint mobile application (the “Application”).

Please read this Privacy Policy carefully. If you do not agree with the terms of this Privacy Policy, please do not access or use the Application.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy.

You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Application after the date such revised Privacy Policy is posted.

Ownership of Data. The Application will collect data that you input into the Application and will process such data as needed to perform various functions of the Application that you choose to use in conjunction with the data that you input. We do not claim any right of ownership to any data that you input into the Application; you retain all rights of ownership to such data.

Collection of Data. We automatically collect usage statistics for various functions offered by the Application, as well as information about your mobile device and usage, including, but not limited to your mobile device ID, mobile device operating system, mobile device GPS location, user name, and your access and duration times while using the Application. If you opt in to have background location on in the Application, Pen-Link will collect data about your location when you are not using the Application and when the Application is closed (as permitted by your device settings). If you have opted-in to sharing your background location with us in the Application, you may remove your permission at any time by going into your operating device settings and toggling off background sharing, or by toggling off location sharing in the Application.

Use of Data. Pen-Link uses the information collected for the operation of the Application, to maintain the quality of the Application, and to provide general statistical analysis regarding use of the Application. We restrict access to this information to our employees and trusted contractors who are required to honor this Privacy Policy. Pen-Link collects information about your location while you are using the Application to enable certain features and functionality, such as sharing of your location with other Application users at your organization. If you have background location enabled, Pen-Link will obtain your device’s location even if you are not using the Application. Your location is never shared with others, except with your consent or as permitted under this Privacy Policy.

Storage of Data. The Application stores the Gateway URL and Gateway IP that you input into the Application. Unique identifiers are stored on the Application that correspond to the data selections and filter selections that you specify while using the Application. Unique identifiers allow the Application to remember your data selections and filter selections without storing your case and target data on the Application. The Gateway URL, Gateway IP, and the unique identifiers for data selections and filter selections are erased from storage when the Application logs out. All case, target, and usage data collected or accessed by the Application is stored in your PLX database.

Security of Data. When you access data while using the Application, it is protected in transit through the use of encryption protocols, such as the Secure Socket Layer (SSL) protocol. Data stored on the Application is secured by user authentication that verifies your user name and password that you specify in your PLX system.

Data Retention. The information collected is retained only as long as reasonably necessary for Pen-Link’s business, accounting, tax or legal purposes.

Third-party Data Access. The Application allows Google Maps to access latitude and longitude data of target locations in the Application. Google Maps is only allowed to access latitude and longitude data if you direct the Application to use Google Maps for mapping or navigation while using the Application.

Miscellaneous. We may also access, preserve and disclose information to investigate, prevent, or take action in connection with: (i) legal process and legal requests; (ii) enforcement of our terms or policies; (iii) claims that any content violates the rights of third-parties; (iv) requests for customer service; (v) technical issues; (vi) protecting the rights, property or personal safety of Pen-Link, its users or the public; (vii) establishing or exercising our legal rights or defending against legal claims; or (viii) as otherwise required by law.

Protection of Children’s Privacy. Our Application is not designed, nor is it intended, to be used by children under 13. Pen-Link does not knowingly collect personal information online from children under 13 and has adopted techniques to ensure compliance with this Privacy Policy and the Children’s Online Privacy Protection Act of 1998 (“COPPA”).

Additional Privacy Policies in Compliance with the EEA Privacy Laws. In addition to the other policies described in this Privacy Policy, residents of the European Union or the EEA are afforded the following additional rights and protections as required by the General Data Privacy Regulation (“GDPR”). Pen-Link does not collect and store Personal Data of EEA residents.
